Klaxy – Terms of Use (EULA)

App: Klaxy – AI Headshots Generator (“App”)

By downloading, accessing, or using the App, you agree to these Terms of Use (EULA) and our Privacy Policy. If you do not agree, do not use the App.
License & Use
- We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.
- You must be at least 13 years old (or the minimum age in your jurisdiction with parental consent). If you are 18+, you confirm you have the legal capacity to accept these Terms.
Accounts & Security
- You’re responsible for your account credentials and all activity under your account.
- Notify us immediately of any unauthorized use or security breach.
Subscription Plans & Billing
We offer the following plans (prices may vary by region, currency, taxes, and Apple’s pricing tiers; the price shown in the App Store at purchase time is authoritative):
- Free: $0.00/month – up to 5 AI headshots/month, standard styles.
- Starter: $9.99/month – up to 25 AI headshots/month, all professional styles.
- Pro: $29.99/month – up to 50 AI headshots/month, all premium styles, lightning-fast processing.
- Premium: $49.99/month – up to 200 AI headshots/month, all styles + custom AI training, instant processing.
Auto-renewal. Subscriptions renew automatically each billing period (monthly) unless canceled at least 24 hours before the end of the current period.
Billing & trials. Charges are processed by Apple using your Apple ID payment method. Any free trials (if offered) convert to paid unless canceled in time.
Manage / cancel. You can manage or cancel your subscription at any time via Settings > [your name] > Subscriptions on your device (or in App Store > Account > Subscriptions).
Refunds. Refunds are handled by Apple under App Store policies. We do not issue developer-side refunds for iOS purchases.
Usage Limits & Fair Use
- Monthly headshot allowances reset each billing cycle and do not roll over.
- Abuse (e.g., scripted generation, reselling credits, bypassing limits) is prohibited and may lead to suspension.
User Content & AI Processing
- You retain ownership of photos you upload (“User Content”). You grant us a worldwide, non-exclusive license to host, process, transform, and display your User Content solely to operate the App and deliver features (e.g., background removal, retouch, AI generation).
- You represent that you have the rights/permissions to upload the content and that it does not infringe others’ rights or violate laws.
- You agree not to upload illegal, harmful, hateful, sexually explicit, or otherwise prohibited content, and not to attempt to generate misleading or abusive outputs.
Generated Outputs & Rights
- Subject to third-party rights (e.g., if you upload protected material or a person’s likeness without permission), we assign to you any rights we may have in the AI-generated headshots created from your uploads for your personal, lawful use.
- You are responsible for ensuring your use of outputs is compliant with applicable laws and third-party rights, including personality/publicity rights.
Privacy
- Our collection and processing of personal data (including photos) are described in our Privacy Policy (link below). By using the App, you consent to such processing as described there.
Acceptable Use
You must not:- Reverse engineer, decompile, scrape, or interfere with the App or its systems.
- Use the App to violate any law or third-party rights.
- Circumvent technical limitations, DRM, or usage caps.
Intellectual Property
The App, brand, software, models, and all related IP remain our property or our licensors’. This EULA does not transfer any IP ownership to you.
Service Changes & Availability
We may modify, suspend, or discontinue any feature or plan (including pricing) with reasonable notice where feasible. We will honor your current billing period.
Disclaimers; Limitation of Liability
The App and outputs are provided “as is” without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill. Our total liability for any claim will not exceed the amount you paid to us for the App in the 3 months preceding the claim.
Termination
We may suspend or terminate access if you breach these Terms or misuse the service. You may stop using the App at any time; termination does not entitle you to refunds except as required by Apple/App Store policies or applicable law.
Governing Law
These Terms are governed by the laws of Republic of Turkey. Local mandatory consumer rights remain unaffected.
